The following terms and conditions apply to all orders placed via my online shop. My online shop is aimed exclusively at consumers.

Payment and conclusion of contract

Advance payment (wire transfer):

If you select advance payment we provide you with our bank details in a separate e-mail and deliver the goods on receipt of funds.

Payment with PayPal:

During the order process you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, PayPal is requested to initiate the payment transaction and thereby I accept your offer.

Right of Withdrawal

Instructions on withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason.

The withdrawal period will expire after 30 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise the right of withdrawal, you must inform me (Sonja Graichen, Am Ammelbach 2, 78078 Niedereschach, Germany, sonjagraichen@aol.com, phone: 07728491) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the enclosed model withdrawal form.Or another clear declaration would work equally as well.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, I shall reimburse you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which I are informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

I may withhold reimbursement until I have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to me. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Warranty and guarantees

Unless otherwise expressly agreed, the statutory liability for defects shall apply.

Due to the special practice of kite flying and making soap bubbles, I am not liable for accidents caused by the goods, except in the scope of application of the Product Liability. Here I refer to the safety instructions in the operating instructions.

My goods are not toys for children.

Information on the recommended kite lines or the wind range are to the best of my knowledge, but without guarantee or liability.

Choice of law

German law shall apply. This choice of law only applies to customers if it does not result in the revocation of the protection guaranteed by the mandatory provisions of the law of the country in which the respective customer’s usual place of residence is located.

The provisions of the UN Convention on Contracts for the International Sale of Goods are explicitly inapplicable.

Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here: https://ec.europa.eu/consumers/odr/.

We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
